Kang Daniel Wins Major Appeal in Concert Revenue Lawsuit
Kang Daniel has achieved a significant legal victory, with the Seoul High Court ruling in his favor in an appeal against a damages lawsuit filed by Genie Music. The dispute, which centered on a shortfall in concert revenue, saw the court overturn a lower court’s decision on August 21, clearing the K-Pop star of personal liability for over USD 510,000 (KRW 700 million). This ruling comes as a major relief for the artist and resolves a complex contractual issue.
Tracing the Contractual Dispute
The legal battle stemmed from a USD 1.6 million (KRW 2.2 billion) concert contract signed in June 2022 between Kang Daniel and Genie Music. The agreement stipulated a year of domestic and international performances, with a clause to recover any revenue shortfall below KRW 2.2 billion through additional shows. Kang Daniel diligently carried out performances in various locations, including Seoul, the Philippines, and Thailand, fulfilling his artistic commitments. However, upon the contract’s conclusion, a shortfall of approximately USD 520,000 (KRW 710 million) remained. Genie Music subsequently filed a damages suit, asserting that the contractual obligations had not been met, leading to a protracted legal process.
Appeals Court Sides with Kang Daniel
In the initial trial, the former agency, KONNECT Entertainment, was held responsible for deficiencies in promotion and planning, being deemed liable for roughly USD 290,000 (KRW 400 million) in damages. This ruling primarily placed the burden on the agency’s operational aspects. However, the appeals court, in its comprehensive review, took a different stance. It emphasized that Kang Daniel himself had faithfully fulfilled all his contractual performance duties, making it difficult to hold him personally accountable for the revenue gap. Furthermore, the court considered two crucial points in its decision: the issue of the shortfall was only raised several months after the contract had already concluded, and critically, Kang Daniel had never been formally asked to hold additional performances to compensate for the deficit. This thorough analysis led to the overturning of the lower court’s decision, marking a decisive and impactful win for Kang Daniel.
